Point of law question?

(f a person is engaged in an illegal activity and suffers harm due to a persons negligence can they recover damages? I remember in a business law cl I had in grad school something that makes me want to say they can not. Specifically m father in law backed out of his drive way and was hit by a person that had no drivers license. This person is now suing my father in law for damages. Can they recover?
